Sex Offenders Have To Move

Interesting article today being reported by the Associated Press. 

Seems that the State of Kentucky passed a new law forbidding sex offenders from living within 1,000 feet of schools, playgrounds and other places where children gather.

Ten sex offenders sued the state in September claiming the new restrictions were unconstitutional because they force sex offenders to move from their property without due process of law and imposes penalties AFTER they have served their sentences. 

U.S. District Judge John Heyburn II refused their request for an injunction Tuesday night, October 10th, saying it wasn’t yet clear whether the law would cause irreparable harm to peope who are forced to move.  The Judge went on to say; “Law enforcement officials retain the discretion to enforce the new statute in a HUMANE and SENSIBLE manner, considering all relevant factors.

The Judge evidently lives in a different world than we do!!  Here’s what happened.  The Fayette County sheriff’s deputies, acting on the order of the Sheriff, went out shortly after midnight to enforce the new law.  They arrested 13 of the registered sex offenders and charged them with a misdemeanor violation.  That is what the Sheriff thinks is “HUMANE” and “SENSIBLE”.  Waiting till after midnight and then rousting them out of bed, taking them down to the jail and booking them.  

And, what’s up with the judge?   Does he really think that forcing people to move because a new law is passed won’t cause irreparable harm.  Some of the people most likely own their own homes and may have lived there for many years and now all of a sudden they are forced to move just because a new law is passed! And, that’s after “serving their time” and “paying back their debt to society”.

Please don’t mis-understand my position on this.  I am totally against child molesters and I think that everything within reason must be done to protect children.  But don’t forget, a “sex offender” can be anything from a child molester to some gay guy who got caught getting a blow job in his car or in a cruise area.  All sex offenses, regardless of whether they occur between consenting adults or adults and children are considered sex offenses and once convicted you become a “sex offender”.   Perhaps the laws need to change to differentiate the level of the offense.

 Anyway, thought you guys might be interested in this.  Many of us, at one time or the other, may have had sex in a public place such as a tea room, in a park, behind the bushes, behind the sand dunes on the beach.  And, we were just lucky, we didn’t get caught.  But if we had, and gotten convicted of a “sex offense”, meaning just a really good blow job, we would be a sex offender.  And, if we live in Fayette County, Kentucky, we’d be forced to sell our home and move.    Just doesn’t sound fair.
